High Court seeks explanation from DM FDC ZANGLI Kupwara for his Arbitrary Action against petitioner merely because he knocked doors of court

The High Court of Jammu and Kashmir and Ladakh has sought an explanation from Divisional Manager Forest Development Coorporation Zangli Kupwara for making entry with red pen in the service book of an employee merely because the said person had challenged the order of DM before the Hon’ble court.
The Court termed the said action of the DFO as unwarranted and Arbitrary.

The petitioner namely Abdul Hamid Sheikh through his counsel advocate Sheikh Manzoor approached the Hon’ble High court with a petition and challenged the entry of the DM made in the service book of the petitioner by red ink which mentioned that The performance of the official is poor as he approached High Court against order of the undersigned and said DM had also recommend for recovery of shortfall from the official after his superannuation.
The Bench of Hon’ble Justice Sanjay Dhar took serious note of the matter and directed that no recovery be made from the petitioner against alleged dues from the petitioner. The court also directed the DM to tender explanation under what circumstances he made such entry merely because the petitioner has knocked the doors of the court.
